Other types of Visa for Entrepreneurs

Without prejudice to the above, it should be noted that, in addition to the general cases of residence permits (i.e. temporary non-profit residence, residence for family reunification, residence for nationals of a Member State of the European Union, ...), the Entrepreneurs Act itself provides for other types of permits of a similar nature. Thus, there are currently the following options:

1. Residence Permit for Entrepreneurs.

Aimed at foreigners who wish to start, develop or manage an economic activity as entrepreneurs. An entrepreneurial activity is considered to be innovative and/or of special economic interest for Spain, and for which a favourable report from ENISA (‘Empresa Nacional de Innovación, S.A.’) must be obtained.

The following will be taken into account for the assessment of the entrepreneurial and business activity.

  1. The professional profile of the applicant and his/her involvement in the project,
  2. The business plan, which must include a description of the project, the products or services to be developed, the financing, which must include the initial investment and the development of the first periods according to the projected business plan.
  3. Added value of this project for the Spanish economy.

2. Residence Authorisation for Highly Qualified Professionals

Intended for companies wishing to incorporate in Spanish territory foreign professionals who are graduates or postgraduates from universities and business schools of recognised prestige, graduates of higher vocational training, or specialists with professional experience of a similar level of at least three years.

3. Intra-company Transfer Residence Authorisation.

This modality is for those foreigners who move to Spain within the framework of an employment, professional or professional training relationship with a company or group of companies established in Spain. They must accredit the existence of the business group, as well as the equivalent higher education degree and professional experience of at least three years at a similar level.

4. Visa for International Teleworking (Digital Nomads).

This type of visa has been developed for foreigners who wish to carry out a work or professional activity at a distance for companies located outside Spanish territory, through the exclusive use of computer, telematic and telecommunication means and systems.

Exceptionally, the activity may be carried out for a company located in Spain, if the percentage of work does not exceed 20% of its total activity.

To apply for this type of visa you must prove:

  1. Be graduates or postgraduates from universities of recognised prestige, professional training and business schools of recognised international prestige or with a minimum professional experience of three years.
  2. Proof of the existence of a real and continuous activity for at least one year with the company/companies with which the worker has an employment or professional relationship abroad.

Despite the elimination of residence permits for investors, the current regulations recognise different ways of obtaining a residence permit for long-term stays, all of which must be studied on a case-by-case basis.
